By accessing and using the website at getderapi.com or the Derapi REST API (collectively, the "Services"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
2. Description of Services
Derapi provides a REST API that gives developers programmatic access to distributed energy resource (DER) data, including but not limited to interconnect queue data, solar irradiance, grid congestion signals, AHJ permitting requirements, and EV charging grid intelligence. We offer Sandbox, Builder, and Production tiers with varying levels of API access and rate limits.
3. API Key and Account Security
You are responsible for maintaining the confidentiality of your API key. You agree to:
- Notify us immediately of any unauthorized use of your API key
- Not share your API key with unauthorized parties
- Not use another user's API key without permission
- Rotate compromised keys promptly via your account dashboard
Derapi is not liable for any loss or damage arising from your failure to maintain API key security.
4. Acceptable Use
You may use our Services for lawful purposes only. You agree not to:
- Use the Services in any way that violates applicable laws or regulations
- Exceed rate limits for your subscription tier
- Attempt to circumvent usage metering, authentication, or access controls
- Use the Services to build a competing DER data API product without prior written consent
- Resell raw API responses as a data product without a separate data redistribution agreement
- Transmit malicious code or interfere with the API infrastructure
- Access endpoints beyond your subscription tier's scope
5. Intellectual Property
The Derapi website, documentation, and API infrastructure are owned by Derapi and protected by intellectual property laws. The DER data provided through the API is sourced from public utility filings and third-party data providers. Your right to use this data is limited to the use permitted by your subscription agreement.
6. Data and API Usage
DER data provided through the Derapi API is derived from public utility interconnect filings, federal energy data sources, and licensed third-party providers. We make reasonable efforts to maintain data accuracy and freshness but do not warrant the completeness or fitness of the data for any particular engineering, financial, or regulatory decision. Users are responsible for independent verification of data used in production systems affecting grid infrastructure.
7. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. Derapi does not warrant that:
- The API will be uninterrupted or error-free
- DER data will be complete, accurate, or current at all times
- The Services will meet your specific engineering or regulatory requirements
8. Limitation of Liability
To the fullest extent permitted by law, Derapi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, including damages arising from reliance on API data in grid operations or investment decisions.
9. Service Level and Uptime
Derapi targets 99.9% API uptime for Production tier customers. Scheduled maintenance windows will be communicated in advance. Real-time status is available at status.getderapi.com. SLA credits, where applicable, are described in your Production plan agreement.

Our website may contain links to third-party websites. These links are provided for your convenience only. Derapi has no control over the content of those websites and accepts no responsibility for them.
11. Privacy Policy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Changes to Terms
Derapi reserves the right to modify these Terms at any time. We will notify you of material changes by email or by posting the updated Terms on this page. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
13. Termination
We may suspend or terminate your API access if you violate these Terms or engage in abusive use patterns. You may cancel your account at any time by contacting us at [email protected].
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of courts located in Portland, Oregon.
